Plaintiff Opportunity Real Estate Equities, LLC filed a significant lawsuit in 2023 against Defendants Spartan Towers, LLC and ASWH, LLC, relating to a business transaction involving a 467,000 square foot office tower (Collier County, Florida Circuit Court Case No.: 23-CA-2271). The allegations included a breach of contract claim relating to the purchase and sale of the office tower.
The case was initially slowed down for several reasons, including a change of counsel by the Defendants and a Chapter 7 bankruptcy filing by one of the Defendants, Spartan Towers, LLC.
In the fall of 2025, Plaintiff replaced its initial counsel with the law firm of Vernon Litigation Group.
In the Spring of 2026, Vernon Litigation Group obtained Sanctions against the Defendants. As a result, the Circuit Court ordered multiple individuals and corporate representatives to appear for depositions immediately (and pay for expedited transcription for the benefit of Plaintiff) and to immediately provide Plaintiff with responses to discovery as well as witness and exhibit lists. As part of granting sanctions, the Court stated that Plaintiff would be entitled to attorney’s fees incurred by Vernon Litigation Group relating to both the depositions and the related motion practice.
Soon thereafter, in May of 2026, Vernon Litigation Group obtained a Final Judgment in favor of Plaintiff, against both defendants (jointly and severally) for an amount in excess of $1.25 million.
